1. Acceptance of Terms
By accessing or using Workraft ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms. We will notify you of material changes via email or through the Service.
2. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account. You agree to notify us immediately of any unauthorized access to or use of your account.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: (a) use the Service to transmit harmful, offensive, or illegal content; (b) attempt to gain unauthorized access to other users’ accounts or our systems; (c) interfere with or disrupt the integrity or performance of the Service; (d) use automated systems or software to extract data from the Service without our express written consent; or (e) sublicense, resell, or redistribute the Service without authorization.
4. Payment Terms
Certain features of the Service require a paid subscription. All fees are stated in US dollars unless otherwise indicated. You authorize us to charge your designated payment method on a recurring basis according to your selected plan. Fees are non-refundable except as required by applicable law or as expressly stated in these Terms. We may change our pricing upon 30 days’ written notice. If payment fails, we may suspend or terminate access to paid features.
5. Intellectual Property
The Service, including its design, features, and underlying technology, is owned by Workraft and protected by intellectual property laws. You retain ownership of all content you upload or create through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to host, store, and display Your Content solely for the purpose of providing the Service. We do not claim ownership of Your Content.
6. Termination
Either party may terminate this agreement at any time. You may cancel your account through the account settings page. We may suspend or terminate your access if you breach these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a period of 30 days following termination, after which we may delete it.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Workraft and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware. Both parties consent to the personal jurisdiction of such courts.
